STUNT DRIVING

This is newly enacted Legislation which came into effect the fall of 2007. It is a serious enforcement tool the Police now have to combat street racing and aggressive dangerous drivers. It is a charge with multiple applications. Anyone caught driving 50 kilometers or more over the posted speed limit not only gets a speeding ticket they are also issued this Stunt Driving Summons for excessive speed  (Stunt Driving). Stunt Driving can also be applied to numerous other Highway Traffic Act charges. If a driver is charged with Careless Driving for weaving in and out of traffic, an officer can also issue a Stunt Driving Charge on top of the Careless Driving Charge. If sitting at a red light and spinning or smoking your tires while accelerating away, you can be issued an Unnecessary Noise Summons as well as a Stunt Driving Summons. If on a motorcycle and you pop a wheelie you will be issued a Stunt Driving charge. Police have the authority (and do with out exception!) to impound the vehicle on the spot for 7 days regardless of the fact if it is your car or not. Your drivers licence will get a 7 day A.D.L.S. (Automatic Drivers Licence Suspension). You will be responsible for the impound fees and daily charges the tow company charges.

STUNT DRIVING SUMMONS

• Summons ordering you to attend court on a specific date.
• If you do not appear a warrant can be issued for your arrest
• Minimum fine of $2,000 up to $10,000
• 6 months in jail with or with out above fine
• Drivers Licence suspension: 1st Conviction up to 2 years. 2nd Conviction not more than 10 years
• 6 Demerit Points

Did he go to jail? What time of day did this happen, tell me it wasn't in traffic or peak hours! I've driven over the limit on occassion myself in my misspent youth but that's too fast.

I want these sorts of drivers off the road, but I have a real issue with judicial powers in the hands of police.

Judicial power???? Yes. In the event that the driver is later found "not guilty" in court, the driver has still suffered numerous penalties:

- towing charges
- storage charges
- time without a license or vehicle (therefore, alternate transportation charges)
- not to mention legal fees, etc.

All of these penalties have been applied, and yet he may be found to be innocent. And, none of the above costs are recoverable.

I repeat, I want these sorts of drivers off the road, and the appropriate penalties applied, but, AFTER a court of law has ruled. The police are not the court are they? Wait.....I guess they are.

This is sooo wrong! The cops shouldn't have this kind of power. If this would have happened when I was a kid, I would have lost my car. There was a pig on my street that would charge out when my 69 396 camaro would leave my folks house.(515 horse) I would idle in 2nd gear, no throttle, But this guy hated cars! 1 block from home everytime! My old man almost came to blows with that @##$%%^ one afternoon. Those "big brother laws" back then, Would have ruined it for my generation.
