The infamous "Grandfather Clause"...


Hey all,

I'm wondering if anyone knows if there's a general list or directory that pertains to the grandfather clause in regards to automobiles.

I'm interested in knowing what I can legally get away with NOT having on an automobile, so I need to know when laws came into effect regarding things sich as seat belts, rear-view/side mirrors, mufflers, and things like that...

Anyone know of anything like that online, or in print?

I'm not looking for a specific year, just something I can refer to.

Generally the car needs to conform to the laws in effect when it was built.  Very few if any laws required retrofitting a car. In Ontario there is of course a seat belt law but you are exempt if your car was not manufactured with seat belts. But for example, for many years seat belts were optional in GM and others. If you car was manufactured with them and optional would mean manufactured with them then they need to be used.

i believe it was 1964 that the gov't made seat belts mandatory in all vehicles.

Yeah, I had a 55 chev no belts, but my 69 camaro had lap belts so I had to wear them. If not in the car when built, don't need 'em!

I had a 52 Chev pickup, that had VW buckets installed with the seatbelts, including the shoulder belt. I was pulled over one time and asked the cop if I had to wear it, He told me if its installed, you have to wear it. I asked what if I took them out, "The truck never came with them, so I could take them out with no problems"

each province has its own regulations regarding specific requirements..
In ontario, the highway traffic act and included regulations give specifics on things like mufflers, mirriors and seatbelts. it is very dull reading and there are many exclusions for things, like shoulder strap portion of seatbelts are not required to be worn on vehicles manufactured before 1973. my 72 olds has the two part
seatbelt for the front seat, i have to wear the lap belt portion, but the upper
section is tucked away in the headliner retainer and not used. things in the
HTA in many cases are not clear and open to a wide interpratation. things like
window coatings (tint) are not permitted, but most windows are , so its all very much it depends on who is enforcing it. the HTA and regulations is available
on line through the ontario government web site....its a great sleep aide!

My 65 Canadian Malibu was assembled in South Africa without seatbelts, but the mounting bolts were there.  Car was specified as with out seat belts. No retrofitting required. How ever; In 65 one of the options was retractable lap seat belts!!!  Guess who has fitted retractable's?  No belts lying around on the seat!biggrin
