Guy selling photos stolen from me on eBay


I was just sent a link to this piece of work selling stolen copyrighted photos as fridge magnets on eBay.

And did you know that to report something on eBay you have to print it off, and then fax it to them... so I have to run around town wasting time just to do it...

Ryan, maybe I'm missing something, but I'd be flattered to have magnets made of a picture of my car.

It would be different if he was scamming/faking a car for sale with my car's picture/s.

I think that once something is posted on the internet it is pretty much fair game. If fhe photo is different in any way that would also impact the situation, cropped, colour adjustemnt etc...

I suggest that if you don't want something copied then don't put it on the internet.

I agree with the fact that whatever you put on the net is fair game, but if it is copyrighted(how do you do that for the net) or watermarked,which means it cant be copied then he should not make money from it.

well the website deviantart clearly states that he is not allowed to copy or reuse your pictures and he is clearly infringing on your copyrights

but it's going to be a pain to do something about it............Ebay will not care, all they care about is making money

I sold a valuable Bronze statue on Ebay, and I copy and pasted a biography of the artist. The author of that bio wasnt happy and Ebay shut me down instantly. I believe that they take copyright infringement seriously. At least they did in my case. (It was at $825 when they shut me down, I had to relist it using my own words, and it sold for $510, bad luck for me.)

Ya, you can't copy and paste writing either.

It states on some websites what is allowed to be used/and if you can alter an image for your own purpose or for sale. Or you can pay for the images. If you go to wikipedia for example. search a car or something/whatever. Click on the image. It will say below the image what copyright rules/what the photographer allows you to use the image or not, and by what circumstances.

I dont know what Deviantarts policy is on this. But read it, and see. Because this guy is using his picture for profit. He might argue he edited the picture first, but you have to see deviantart policy/rules. Still wrong though.
But from what I am reading online, a lot of pictures are getting stolen from deviantart

The interent is a public domain and not just in big cities, its worldwide. Personally I hve to be one of the top posters of photos I have taken on this site, I post 400 each year from Autofest in Oshawa alone. I see photos I have taken all the time on other web sites and  forums. No big deal to me, flattering actually.

I believe that I read somewhere along the way that the copyright of the photo remains forever with whoever took the picture. Even if the photo is sold, the copyright still stays with the owner unless written agreement is made. I don't remember how long the copyright lasts, but it is years and years and does not have to be registered. Atleast this is what I believe I read........

I save pics of cars I see on the 'net as well. Never use them for any personal gain.... Plus, I have thousands of photos I've taken at car shows over the years on the net as well. I don't copyright any of them....Maybe I should.

People have this idea that the internet is fair game, but it's not. Copyright laws do apply, and on all of mine there is a copyright, if the guy had just asked me lie a lot of other people do, I would have said sure as long as you send me one or two, but just grabbing all the photos you can, and selling them without the owners consent is disrespectful and illegal.

Posting my photos on other sites is fine unless they are charging to see them or claiming ownership, I prefer they link to my original if someone does post them.

Now with this seller on eBay, I asked who took the photo, he said he took it... (I only posted one of his replies) then he told me he got it as a gift... supposedly from the photographer and claimed the car is a US car.

I will say that I am a little flattered that he thought my photo is good enough to sell, I mean the car is scratched up, has some rust and is dirty in the photo (globs of mud on the tires even) but it all goes back to him not asking in the first place.

I see you point about seeking permission. I can see where it would be a bit of a shock to see your photo at first. The issue is it's not wiorth the effort to do anything about it unless you are a professional photographer.  Getty images for example slaps threats on people all the time but they have the money and lawyers to follow through. Although you are right that it is protected material what are you going to do? 

As a newsletter editor I always seek permission and properly credit stories and photos, its just the right thing to do but what people do with my work is really out of my control unless I want to waste a ton of time and money.

Define "professional photographer"

I sell my photos all the time, I have been collaborating on books and other projects more and more lately.

Not sure what I am going to do to be honest because it's not just my photo, but the photos of a lot of other people who do this sort of a thing for a living.

This is why I posted it, to get feed back from you guys, and all of it has been appreciated!

I would say you are a professional if you are paid for your work which you are. It is a tough situation though. Telling him to cease and decsist is a good strategy. If he does not then you might want to spend money and time on legal action. If he is a kid making walking around money from this like he says your financial recousre will be very limited.

I havn't looked at what this guy is selling but I did notice on ebay a guy was making fridge magnets out of Beaumont pictures that guys posted on various on line sites for sale.  The blue rag top and a gold custom from Alberta. I wonder if it's the same guy? I think these ones were from Thiland though? I will admit I would NOT like my pictures used without my permission but I wouldn't wast my time trying to do anything about if they did get used. It's just disrespectfull.

Dumb question, but how do you copyright your photo's?  

And if they are protected by copyright, that means you must have felt prepared to defend your copyright, or you wouldn't have bothered to copyright them.
